Hey, Sacramento Short Sale Agent -- How Solid is That Offer?

When I started in the real estate business, I could not understand why an agent would not answer her phone. Today, I know the answer to that question. My phone rings constantly. If you want to get through to me, it's better to send an email. As a Sacramento short sale agent, I field not only calls from other agents but also from prospective short sale sellers and from those buyers driving by or looking online.

Often, the calls I receive from agents are the same. The basically want to know one thing. How solid is that offer? They can see that my listing is either active short contingent or in pending status. Well, some of them can't read those words, but most of them can. Some of them block out the "contingent" or "pending" status in their minds and just see the word "short sale," so they go for it like a thirsty man who just crawled across the desert to an oasis.

The thing is I am not privy to the inner workings of a buyer's mind. I honestly do not know how committed any particular buyer is to any of my short sale listings. That's because it is impossible to know these things unless I am that person, and I am not. I'm just a Sacramento short sale agent, not Uri Geller.

A buyer can swear up and down to me that she will wait for short sale approval. That buyer can write a big, fat, earnest money deposit and put that money into escrow. She can sign a short sale addendum promising to wait 180 days for approval. She can promise to paint my house if she cancels, throwing herself to the ground in my front yard, clutching a sprinkler-head and swearing on all that is holy; it doesn't matter. I still have no idea. Things change. People change.

If a short sale is canceling, I will immediately put it back on the market. I put it back as an active short sale, with a notation it is pending rescission. Beyond that, I do not know. If a buyer wants to submit a back-up offer, it's a good idea to find out how many I have. If you want to submit a 3rd or 4th back up offer, knock yourself out. But don't ask me to predict the likelihood of a buyer closing escrow. I don't have a crystal ball and, despite growing up in the '60s, I never learned how to read Tarot cards.

Stories From the Trenches: Is Your Short Sale Agent a Crook?

Whenever I talk about crooked real estate agents, I get a ton of emails from agents protesting the term. I get asked: Why do you have to bring up crooked short sale agents? Why make consumers think that real estate agents are unethical or crooked?

Well, I hate to say this but consumers already believe it. I'm not putting ideas into anybody's head that aren't already there. A smart consumer is always cautious. Especially when it comes to hiring a Sacramento short sale agent or anybody for that matter to help keep a home out of foreclosure.

Even the Sacramento Bee this morning has a front page story of how a new scam is hitting distressed homeowners. The legislature made it against the law to collect upfront fees without jumping through a bunch of hoops, so fraudsters are now collecting fees to file lawsuits against banks. Because anybody can collect a fee to file a lawsuit, regardless of how petty. The Bee says these lawsuit filings have doubled over the last 6 months as compared to last year.

A homeowner with an underwater home is often frustrated after trying to deal with the bank. Before a short sale, I hear story after story of how owners got the run-around from the bank or the bank lost paperwork or the bank tried to force the homeowner to send money without a written agreement. People don't know who to trust. They are confused.

I recently told a client that she should be in no rush to buy a home. She has a home that is underwater by at least $100,000. Like many short sale sellers lately, her parents are offering to buy her a home. But she has specific needs that are difficult to fulfill. She seems to want to make homes work for her that are not right for her. Just to buy a home. I suggested she slow down, take her time and perhaps she should consider buying a brand new home. She didn't want to hear that, I guess, and sent an email saying my services are no longer required.

Another potential short sale seller asked me to send him a copy of the listing agreement before we continued our conversation. This was a new one on me, but it showed me that the client is distrustful of real estate agents. And I don't blame him for being cautious, even though in my case it's unwarranted. There are way too many crooks in the short sale business.

Just yesterday some agent called to say he has investors looking to buy short sales. He wanted to know if I had any short sale listings in Sacramento. Said he found me on Zillow. First red flag -- he already knows I have several dozen short sales in active inventory because my listings are in front of his nose in Zillow.

Second red flag -- he doesn't need to have a conversation with me that involves sharing his philosophy about buying a Sacramento short sale unless he wants to do something unethical or against the law. He could just write an offer, like every other buyer's agent in town. But I've talked with these types of guys before. They want me to induce a seller to accept a lowball offer so they can buy the home way under market and then flip it. They also promise I'll get the listing when they resell. Big bucks for me and them -- screw the sellers and the bank.

There are crooks everywhere. After I rejected this agent and disconnected the call, he had the audacity to call back and leave a message on my cell about how I am passing up millions of dollars in commissions. Yup, millions of dollars. Ha. This guy apparently believes his own lies, which makes him all the more dangerous. Be careful when you choose a Sacramento short sale agent.
